The present General Conditions regulate the contract of sale, concluded through the website (www.curlyness.com) between CurlyNess Unipessoal, Lda., headquartered at Avenida Fernando Namora 68B, Charneca Caparica, Setúbal, with NIF: 515258270, as the seller (hereinafter CurlyNess), and the Buyer who, on this website, has concluded a Purchase process for a certain product.

APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
By making purchases on the website (www.curlyness.com), the Buyer accepts these General Conditions of Sale.
PRICE OF THE PRODUCTS
The Sale Price corresponds to the price in force during the purchase process and includes VAT at the rate in force.
The price of transport and/or delivery, where applicable, is added to the purchase price of the product (s) being calculated during the purchase process.
PRODUCT AVAILABILITY
The online sales platform (www.curlyness.com) is designed so that the Client knows, in advance, the availability of the product. However, CurlyNess cannot avoid stock shortages, namely those resulting from force majeure.
In cases where it is not possible for CurlyNess to ensure delivery of the product purchased by the customer within 15 days, CurlyNess will credit the customer for the amount spent by the customer, using the same method of payment used by the customer.
PRESENTATION OF PRODUCTS
The products for sale are described and presented according to their original characteristics, in accordance with the information provided by the respective responsible party.
ORDERING AND PAYMENT
The payment systems available are those announced on the site and may vary according to the product chosen by the Customer, his area of residence and the delivery system chosen and/or available.
PRODUCT DELIVERY
All purchases made online will be delivered to the address indicated by the consumer when filling out the purchase form.
The delivery of the Products presupposes the advance or simultaneous payment of the price of the product and, when applicable, of the price of transport and/or delivery.
Deliveries are made during business hours (9:00 a.m. to 7:00 p.m.) depending on the transport company and the carrier’s route, as well as the shipping method selected.
Shipping will be made the next business day after CurlyNess receives the order. Delivery will be made in a period between 1 to 15 working days, varying depending on the destination and the type of transport selected.
FREE TERMINATION
Goods supplied by CurlyNess are sealed and not returnable, for health protection or hygiene reasons, when opened after delivery;
EXCHANGES:
DEFECTIVE PRODUCT AND/OR PACKAGING
When the packaging or the product is damaged at the time of delivery, CurlyNess will exchange the product
a) by another, equal one,
b) unless the Customer requests the exchange for a different product but of equal or greater value,
The Client must check the packaging and its contents at the moment of delivery and immediately present a complaint to the transporter, if it shows signs of being damaged.
The exchange must be previously registered through the email info@curlyness.com , indicating the order number, as well as the products to be exchanged, and the reason given in accordance with the previous number.
The products must be returned to the address indicated by CurlyNess, and the postal costs of the return will be borne by CurlyNess.
Where applicable, payment will be returned within 15 days of CurlyNess checking the returned goods.
RETURNS
CurlyNess will accept product returns, provided that the return is made
a) within 14 days of receipt of the order by the Customer;
b) with the article in good condition, in its original unviolated packaging, without having tried the products to be returned, and accompanied by the respective invoice
The return must be previously registered through the email info@curlyness.com, indicating the order number, as well as the products to be returned, the reason for the return and, when applicable, the desired product.
The products must be returned to the address indicated by CurlyNess, and the respective costs will be borne by the Customer.
Where applicable, payment will be refunded within 15 days of receipt and verification of the intact condition of the returned products. This refund will be made by the same method used to pay for the order.

LIABILITY FOR INTERNET USE
CurlyNess does not have any responsibility regarding possible damages or problems derived from the use of the internet, such as external intrusions or computer viruses.
ORDER CANCELLATION
All orders may be requested to be cancelled up until dispatch from the online store and must be requested via email to info@curlyness.com.
If the cancellation of the order is total or partial, the order will be cancelled and the amount will not be charged.
If the payment of the order has already been made, CurlyNess will contact the Customer to inform him of the cancellation and to ask for any information that may be necessary to effect the return of the amount charged. The return period may be up to 5 working days.
APPLICABLE LAW AND JURISDICTION
Portuguese Law is applicable to all issues related to the present General Conditions.
All disputes arising from this contract will be submitted to the competent courts of Portugal.
